TERMS AND CONDITIONS OF THE WWW.VERYYOU.PL AND WWW.VERYYOU.EU STORE

§1 General Provisions

  1. The owner of the Website located at www.veryyou.pl is VERY YOU SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (Limited Liability Company) with its registered office in NOWOGARD, WOJCIESZYN 32, entered into the register of entrepreneurs of the National Court Register (KRS) kept by the District Court SZCZECIN-CENTRUM, 13th Commercial Division of the National Court Register under the KRS number: 0001141560, NIP (Tax Identification Number): 8561938185, REGON (National Business Registry Number): 540306962, with a share capital of 48,000.00 PLN.

  2. These Terms and Conditions define the rules for using the Website and its functionalities, including the type and scope of services provided, in particular electronic services provided by its owner, terms and conditions for placing orders, technical requirements, the method of concluding and terminating distance contracts, payment rules and deadlines, delivery terms, and the complaint procedure.

§2 Definitions

  • Price – the value expressed in monetary units that the Customer is obliged to pay the Seller.

  • Business Day – a day of the week from Monday to Friday, excluding public holidays.

  • Delivery – means the delivery of the Goods to the Customer by the Seller.

  • DSA – Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act).

  • Civil Code – the Civil Code Act of April 23, 1964.

  • Customer – an entity making a Purchase for their own consumption and acquiring the rights to its ownership, or intending to make a Purchase. A natural person with full legal capacity (and in cases provided for by law, also limited legal capacity), a legal person, and an organizational unit without legal personality.

  • Consumer – a natural person concluding a legal transaction with an entrepreneur that is not directly related to their business or professional activity.

  • Offer – a proposal of Products available on the Website, including essential information about the Product or Service.

  • Privacy Policy – a document defining the rules for processing personal data, available at https://www.veryyou.pl/policies/privacy-policy.

  • Product – any Good or Service within the meaning of the provisions on countering unfair market practices; the Product is provided subject to payment, unless stated otherwise.

  • Physical Product – a product subject to physical dispatch via mail/courier or which can be collected in person.

  • Entrepreneur – a natural person, a legal person, and an organizational unit that is not a legal person, conducting business activity in its own name.

  • Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it does not have a professional character for that person.

  • Terms and Conditions – this document.

  • Website – the website www.veryyou.pl.

  • Seller – the Owner of the Website indicated in §1 sec. 1.

  • Goods – an item that is the subject of a contract concluded between the Seller and the Customer.

  • Distance Contract – a contract concluded without the simultaneous physical presence of the parties.

  • Electronic Service – a service provided electronically via the Website.

§3 Electronic services on the Website

  1. The following Electronic Services are available on the Website: blog, contact form, newsletter, search engine, product filtering, user accounts.

  2. The provision of Electronic Services to Customers on the Website takes place under the conditions specified in the Terms and Conditions.

  3. It is forbidden to transmit content of an unlawful and illegal nature (e.g., promoting terrorism, violating copyrights). Detailed information can be found in §17 of these Terms and Conditions.

§4 Rules for concluding contracts

  1. The Terms and Conditions and the Offer define the rules of cooperation and the conditions for the performance of the contract.

  2. At the very bottom of the Website, the Terms and Conditions are made available to the Customer free of charge.

  3. The Customer may not place an Order using incorrect personal data, anonymously, or under a pseudonym.

  4. In the event of a discrepancy between the content of the Terms and Conditions and the Offer, the Offer is binding.

  5. The contract is concluded upon clicking the button that unequivocally indicates the intention to purchase with an obligation to pay. Receipt of the order will be confirmed electronically.

§5 Price (Omnibus Directive)

  1. The Price is a gross price and includes all taxes required by law (including VAT).

  2. The Price does not include information regarding delivery costs or other additional costs, which the Customer will be informed about before placing the order.

  3. The reduced price is the price applicable after a reduction in the Product's price.

  4. The lowest price is the lowest price for the Product that was applicable during the 30-day period prior to the introduction of the reduction. In the case of a product offered for sale for a period shorter than 30 days, the lowest price is the lowest price applicable from the day the Product began to be offered until the day the reduction was introduced.

  5. The Seller reserves the right to make changes to the prices of the Products. Changes do not affect already concluded Contracts.

§6 Rules of cooperation and placing orders

  1. The Customer may use the Website 24 hours a day. Orders placed on non-working days are processed on the next Business Day.

  2. The Customer may choose the following payment methods:

    • cash on delivery (payment to the courier);

    • standard bank transfer – payable directly to the Seller's account;

    • electronic transfer – via external payment operators.

  3. To Purchase Products through the Website, the Customer must add the Product to the cart, fill out the order form, review the costs, accept the Terms and Conditions, and make the payment.

§7 Physical Product - order processing

  1. If the ordered item is unavailable, the Customer will be informed electronically.

  2. The ordered Goods will be dispatched no later than 14 days from the date of payment of the full price along with delivery costs (unless the Offer states otherwise).

§8 Technical conditions

  1. To use the Website, it is necessary to have an up-to-date web browser with Internet access and an active e-mail account.

§9 Complaint (Conformity of the goods with the contract)

  1. The Seller is liable for the conformity of the Goods with the contract on the principles set out in Art. 43a and subsequent articles of the Consumer Rights Act.

  2. If the Goods do not conform to the contract, the Customer may demand their repair or replacement.

  3. The Seller may make a replacement when the Customer demands a repair, or a repair when the Customer demands a replacement, if bringing the goods into conformity in the manner chosen by the Customer is impossible or would require excessive costs.

  4. The Customer may submit a statement on price reduction or withdrawal from the contract when:

    • the Seller has refused to bring the Goods into conformity with the contract;

    • the lack of conformity persists despite attempts to repair/replace;

    • the lack of conformity is significant enough to justify an immediate price reduction or withdrawal;

    • it is clear from the Seller's statement that they will not bring the Goods into conformity within a reasonable time.

  5. The Customer may submit a complaint to the e-mail address: contact@veryyou.pl or by mail. The Seller will respond to it within 14 days.

§10 Warranty

  1. Apart from the rights arising from the provisions on the conformity of the goods with the contract, some Goods may be covered by a manufacturer's warranty.

§11 Withdrawal from the contract

  1. A Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the contract within 14 days without giving any reason.

  2. The period for withdrawal from the contract begins on the day the Customer takes possession of the Goods, and in the case of an order for multiple items delivered separately – from the day the last item from the order is delivered.

  3. To exercise the right of withdrawal, the Customer must inform the Seller of their decision through an unequivocal statement (e.g., via contact form, e-mail, or letter). Appendix No. 1 may be used for this purpose.

  4. The right to withdraw from the contract does not apply, among others, to contracts:

    • where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs (personalized products);

    • for the supply of digital content not recorded on a tangible medium, with the express consent of the consumer;

    • supplied in a sealed package, which cannot be returned after opening due to health protection or hygiene reasons, if the package has been opened after delivery.

  5. The Customer is liable for any diminished value of the Product resulting from using it in a manner that goes beyond what is necessary to establish its nature and characteristics.

§12 Returns – consequences of withdrawal from the contract

  1. In the event of withdrawal, the Seller shall refund all payments received from the Customer, including the costs of the cheapest standard delivery method offered on the Website, without undue delay, and no later than 14 days from the day of receiving the withdrawal statement.

  2. Return address: WOJCIESZYN 32, 72-200 NOWOGARD.

  3. The refund will be made using the same payment methods that were used by the Customer.

  4. The Seller may withhold the refund until receipt of the Goods back or until the Customer supplies evidence of having sent back the Goods (whichever occurs first).

  5. The Customer is obliged to send back the Goods at their own expense without undue delay, and in any event not later than 14 days from the day on which they withdrew from the contract.

§13 User Panel

  1. The Seller provides the possibility of creating a User Account. The agreement is maintained free of charge for an indefinite period.

  2. The Customer may request the deletion of the Account with a 14-day notice period without giving any reason.

§14 Image and §15 Copyrights

  1. The copyrights to all materials (photos, texts, graphics) on the Website belong to the Seller.

  2. Copying and distributing materials without the Seller's consent is prohibited and subject to legal protection.

§16 Payments

  1. The payment card operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, KRS: 0000347935, NIP: 7792369887.

§17 Content restrictions (DSA)

  1. It is prohibited for Customers to post content that is illegal, promotes terrorism, or violates copyrights or personal rights.

  2. The Owner has established a central Contact Point in accordance with the Digital Services Act (DSA), available at: https://www.veryyou.pl/pages/contact, for reporting illegal content.

  3. The Owner may suspend the provision of services to users who frequently provide manifestly illegal content or abuse the reporting system.

§18 Final provisions

  1. The Consumer has the option of using out-of-court complaint and redress procedures, including via the ODR platform: http://ec.europa.eu/consumers/odr.

  2. The law applicable to contracts concluded with the Seller is Polish law, provided that this does not deprive the Consumer of the protection granted to them by the mandatory provisions of the country of their habitual residence.

  3. The competent court is a Polish court.

  4. The Terms and Conditions are effective from 2026-06-23 (adjust to the current date of publication).

§19 Other provisions regarding entrepreneurs

  1. The provisions of this section apply solely to Entrepreneurs who are not Entrepreneurs with consumer rights (B2B transactions).

  2. The Seller's liability under the statutory warranty for physical defects (rękojmia) is completely excluded.

  3. Entrepreneurs are not entitled to the right to withdraw from the contract without giving a reason (return within 14 days).

  4. The Seller's liability for damages is limited to twice the value of the paid order.
